These Terms are subject to change.
- DNA does not accommodate refunds or transfers.
- Paid memberships are on a weekly non-contractual basis, and can be canceled anytime.
- Missed training sessions do not roll over.
- Ongoing clients’ time-slots can be reserved for a limited time for reasons such as; work travel, vacation, etc.,
By purchasing any training package and/or participating, You and/or your child understand that DNA Personal Training’s programs involve some strenuous athletic and physical activities and recognize that participation in such strenuous activities inherently involve health and injury risks, which can be very serious, to include death. You understand and knowingly accept these risks, you represent that you have no physical or health issues that might inhibit your participation in DNA’s training sessions, or might increase your risks. You further represent that you have recently received medical clearance and approval from a physician to participate in highly strenuous exercise activities. You understand that it is your responsibility to regulate the scope and intensity of your participation in each training session so that you are not overtaxed, and you promise that you will do so. You further acknowledge that by electing to continue participation in training, your assumption of risk will be ongoing and absolute. Last, you acknowledge that any failure on your part to exercise prudence may significantly increase the risks you will incur.
On behalf of yourself and on behalf of your minor child (to the extent allowed by law), you hereby release in full and forever discharge and hold harmless, DNA Personal Training, LLC, its instructors, agents, trainers, volunteers, officers, employees, including as well, any third party sponsors of DNA Personal Training and associated Fitness Program activities, lessors of premises used to conduct constituent events, other participating or sponsoring agencies for the Program, and all others associated with producing and administering the DNA Personal Training & Fitness Programs, whether acting within the scope of their employment or otherwise, of any liability, loss, cost, damage, expense, claim, or suit whatsoever for any or all loss, illness, harm, cost, expense, claim, suit, personal injury, disability or death, resulting from your or your minor child’s involvement in any aspect of the Program. You understand that the owner of and agent for any Property where a session is to be conducted and/or any Session Sponsor will be a third party beneficiary of this Waiver of Liability and Release.
Media / Promotional Release.
You understand that DNA may photograph, video or record events or sessions for promotional purposes, and you authorize express written permission for use of pictures, likenesses, testimonials and results, in full or in part, for promotional purposes/ and understand that you are not entitled to any compensation for such.
To the fullest extent allowed by law, You, for yourself and/or your minor child, and for any of your respective heirs, assigns, personal representatives and next of kin, hereby agree to indemnify and hold harmless all the parties involved hereof from and against any and all liabilities arising from your participation in the DNA Personal Training Fitness Program. This undertaking to provide indemnity shall apply, to the fullest extent allowed by law, even if the liability asserted against any of the indemnified parties arises wholly or partially from their own negligence.
